Noida Authority orders builder to seal more than 1,000 illegally constructed flats in Noida

The Greater Noida Authority Industrial Development Authority (GNIDA) has ordered Supertech to seal 1,009 apartments in their Czar project for flouting the authorized sanctioned plan. The authority claims the builder was sanctioned for 844 units but built 1,853 units.

What is worse is more than half of these unsanctioned units have been sold already – these people probably have a long, hard road ahead to get an apartment or their money back from the builder. We, at PropertyChek, sympathize with the owners and wish them well in this journey.

The other interesting thing to note in this article is Supertech has flouted sanctioned plans and faced the issue of illegal construction earlier in courts as well, but decided again to flout rules in the Czar project! P. C. Gupta’s comments quoted in the article are key, the article states “Construction cannot be carried out first and sanctions applied for later” – we agree a 100% and hence believe it is very important for buyers to confirm the builder has Title and required Approvals to undertake construction for the upcoming project before starting construction.

Lastly, the article indicates banks probably issued home loans against the property and failed to do appropriate due diligence. We see time and again that bank’s due diligence is not enough to protect buyers against fraud. Real another blog entry on this topic here
